Terms & Conditions

These terms govern the sale of Implagen prosthetic dental components to legal entities (dental clinics, laboratories, distributors) across the European Union. By placing an order, you accept these terms.

2. B2B Only

Implagen sells exclusively to legal entities — dental clinics, dental laboratories, healthcare distributors and other professional buyers. Consumer sales (natural persons acting outside a commercial activity) are not accepted. By ordering, the Buyer represents that it is a legal entity and provides a valid VAT / fiscal identification number.

3. Orders & Contract Formation

Orders may be placed via the website, WhatsApp (+40 746 111 131) or email. An order becomes a binding contract only after Implagen issues a written order confirmation (email or proforma invoice). Product availability, lead time and price are those stated in the confirmation.

4. Prices & Payment

• All prices are quoted in EUR, exclusive of VAT unless stated otherwise.
• VAT is added at the legal rate applicable at the invoice date (currently 19% in Romania).
• Standard payment: full advance payment via bank transfer against proforma invoice.
• Deferred payment terms may be granted to established partners upon separate agreement.
• Late payment attracts penalty interest at the reference rate + 8 percentage points, per Law 72/2013.

5. Delivery

Standard lead time is 24–48h for stocked items within the EU. Shipping is performed by courier (DPD, FanCourier, UPS). Risk transfers to the Buyer upon handover to the courier (Incoterms DAP unless otherwise agreed). See our Delivery policy for full terms.

6. Warranty

Implagen grants a 5-year manufacturing defect warranty on all titanium prosthetic components, from the invoice date. Details and exclusions are described in the Warranty policy.

7. Returns

As Implagen's products are custom-manufactured medical devices, statutory withdrawal rights for consumers do not apply (B2B). Returns are accepted only for manufacturing defects, wrong item shipped, or damage in transit — see the Returns policy.

8. Intellectual Property & Trademarks

Third-party brand names referenced on this website (Megagen AnyRidge®, Dentium Implantium®, MIS Seven®, Biomet 3i®, Dentsply Ankylos®, Anthogyr Axiom®, ARDS®, Bredent Copa®, Bredent Sky®, Nobel Biocare®, Straumann® etc.) are trademarks of their respective owners. Implagen is not affiliated with, endorsed by, or sponsored by any of these manufacturers. Compatibility references describe technical fit only.

9. Liability

Implagen's liability for direct damages is capped at the invoiced value of the products giving rise to the claim. Implagen is not liable for indirect, consequential or incidental damages, including loss of profit, loss of clinical hours, or damages caused by improper handling, sterilisation, storage or clinical use by the Buyer or a third party.

10. Clinical Responsibility

Products are professional dental prosthetic components. Selection, sterilisation, insertion and clinical use are the sole responsibility of the treating clinician / laboratory technician, who must possess the qualifications required by applicable regulations.

11. Data Protection

Personal data provided during the ordering process is processed as described in our Privacy policy, in accordance with Regulation (EU) 2016/679 (GDPR) and Law 190/2018.

12. Governing Law & Disputes

These terms are governed by Romanian law. Any dispute shall be settled amicably; failing which the competent courts of Bucharest, Romania have exclusive jurisdiction. Consumers (should the exceptional case arise) may also file complaints via the EU ODR platform at ec.europa.eu/consumers/odr and, in Romania, at ANPC — anpc.ro.

13. Amendments

Implagen may update these terms. The version applicable to a given order is the one published on the website at the moment the order is placed.
